          Best case scenario I get the win, set the bailiff on him, report him to the ATO for his tax evasion scheme where he is collaborating with his clients to split his income. Oh and the local / federal police for fraud. Maybe let Gumtree and Carsales know too, along with the car clubs and Facebook group That'll make disposing of future car collections fun for him.

          Ah, the things that time and a sadistic pursuit of fairness lead to.

              I've actually got a vapour blasting cabinet, bigger compressor and some paint guns in mind And while money is short at the moment it's largely because I'm renovating the house - it's more doable given my current hermit-like existence with depression.

              However something that cheered me up a little was the pre-trial conference yesterday.

              Once upon a time, back when I was married, we had two cats. At one stage we were living in a nice house in Leeming and there were a few other cats in the neighbourhood. Our male cat would get injured by a particularly fearsome cat quite often. The owners of the cat decided to move and left their precious kitty behind to terrorise the neighbourhood without them. The cat would walk in through our cat door in the laundry and eat our cats food straight out of their bowls. And the big bastard was tough to even get near as his "human radar" was military grade - food, encouragement, anything we tried would result in him spotting us and disappearing quick smart.

              Until one day when I trapped him in the laundry by using a long handled broom to hold the cat door shut while I was positioned behind a corner wall.

              This cat was unhappy. You've never heard such growls while a creature literally pinged off of the walls trying to intimidate and escape.

              I'm not allowed to share any details of yesterdays court case but I was reminded by that story and hope you enjoyed it

              ...Also I've called the ATO and let them know they should investigate him for "Income Filtering" using his friends bank account (which I supplied them the details of).

              Next step is the court case some time early January.




              PS - I used some welders gloves to put the cat in to a Rangers cage and ensured the owners picked it up. They weren't happy about it and nor was the cat. But I was

                    An update on this.

                    Went to court for the "Listing Date Hearing" on Valentines Day. Considering the aim of the appearance is to simply set a date for trial it couldn't have gone any better.

                    I said four words during the entire hearing: "Thank you, Your Honour".

                    Dickhead from NSW decided it was in his best interest to interrupt the judge, talk over him, use phrases like "with all due respect" and finally, when the date of the 11th of July was given, "I'll have to check my schedule".

                    If there was a template of how to put a judge off-side then this guy wrote it. Looking forward to the 11th of July

                        Negative. He had leave from the court to attend this hearing by phone.

                        He will be here for the hearing itself. The judge made it very, very clear that he had to attend in person. It was a joy to behold - even the court stenographer looked up from recording notes.

                          Good luck I guess. I took a retard to court, but because it was about malpractice based upon international tax the judge wanted an expert witness, expert witness would have been $6,000 p/h including flight time from sydney, I would have won, I wouldn't have had to pay a cent, but I had to skip the country for other reasons so the retard got off.

                          I was looking forward to him paying me $15k + $50k court costs

                            Win.

                            Today I heard from a law firm representing the Defendant. He has made an offer to settle my claim in full and withdraw his counter claim - providing I accept by COB Friday.

                            If I don't accept the offer by then it will expire and the hearing goes ahead as scheduled, next week. They would then seek to have all of the Defendant's travel expenses deducted from any monies the Court rules are owed to me. And unfortunately that would be fair enough.

                            Frankly I was looking forward to the hearing for a whole host of reasons that a victim and plaintiff might feel in this situation. But their offer is for the full amount I'm claiming and as such I can't imagine the Magistrate feeling positively towards me for wasting his time - especially after seeing his response to the Defendant during the listing hearing.

                            I'm compelled to accept. But I'm not a fan of being the one compelled to do something. So I've agreed to their offer on one condition - that the money is in my account by the COB next Monday.

                            Guess that puts the issue of a pre-hearing settlement back on him - to sort through with his lawyers.

                            Imagine having to fork out for time-critical work as well as pony up the cash for settlement...

                              Otherwise the hearing goes ahead as scheduled.
