    Thanks mate.

I'm not too sure what a pre-hearing settlement has on the plans I had.

Contacting the Italian NSW car clubs is still a possibility I think - he has quite a collection of classics for sale on CarSales using a fake name. They can use that information to warn anyone that contacts them for a reference on the seller. As many would do. As I should have done... although until now I don't think they would have had anything concrete on him.

So is it time to send A Current Affair to his door?

Just make sure you read the fine print of the settlement agreement. He'll probably put something in there indicating that any bad-mouthing of him going forward may be met with legal action, etc.

Roy the first defence against any action for libel is that you are telling the truth.
Smart thinking about reading the small print none the less.

                    What a dick...

So I got my money. I had to be pretty assertive with his lawyers to ensure I got the money paid in full before the court case. Took them three goes to get it right and they only just made it happen in time. But it was cleared and in my account and the Court case was dismissed as a result of the settlement agreement.

                    But then!

I get an email from a Fiat contact I've made in South Australia. He let me know that the guy has just advertised another collection of cars - using the same alias as he caught me out with.

My family said "let it go, you have your money, don't get involved in case he sends people over to hurt you". But I reckon that if I do that, and if he stings someone else, then my lack of action is partly to blame.

So here's a list of things I've done

                    1. Reported him to Gumtree. His accounts are now suspended. They've asked me to have ACORN (the Police division for online fraud) get in touch with them.
                    2. Lodged another report with ACORN. Decided to include the mate that allows his bank account to be used.
                    3. Reported his ads on Carsales. There's a couple of hundred thousand dollars advertised on there.
                    4. Contacted the NSW Fiat and Lancia Car Club to let them know about him and his actions, asking them to warn potential buyers.
                    5. Reminded the ATO about him and let them know he's up to his tricks again.

Hopefully that'll leave him with several hundred thousand dollars worth of cars that he can't even market, at least fraudulently.

But the best one. He's an Accountant. So:

                    6. Contacted the Australian Institute for Chartered Accountants. Suggested that the bank accounts he is using that belong to other people might be being used without their knowledge. Perhaps they're clients.

Be a shame if he isn't able to be an Accountant anymore. It's tax time right about now, isn't it?

It's understandable that he wouldn't want anything to go near a court hearing.

It is legal to obtain court transcripts and publish them on web sites, right?

Thing is, there's nothing official from the court itself. I have a 20 page defense document written by him which amounts to "I use a fake name for safety" and "I don't think Loud could afford the car". Pretty sure I'm not allowed to publish any of that.

However there's absolutely nothing defamatory about me continuing to tell people / organisations what he did to me. It's the truth, he can try and take legal action and I'll laugh at him like I did last time he threatened me with it. I actually laughed AT him. He loved that

As a backup I've also got a "Loud threatened me and I reported it to the Police". I hadn't, so I contacted the NSW Police under the Freedom Of Information Act to obtain a document showing there was no record of a complaint against me. Plus he won't have any evidence because it didn't happen.

So I'll just continue on my merry quest to make life miserable for him in every way I can. Legally.

Not having a non disclosure agreement on your settlement gives you a lot of latitude for freely discussing your dispute, the process and the resolution. Well done! Have fun!
