    if a tenant of rental house is found to have a illegal dog in property which is breech of contract then would she (the tenant) lose bond??
    or is bond for damages only?

    in other words does breech of contract result in loss of bond and eviction or just eviction and keep bond?

    wat does the contract say ? the T and C's of the contract should list the provisions for loss of bond.

    Depends too ... What side of the argument are you on ??
    Some say he eats sidchrome for breakfast

      From past experience it just depends on the agent. It is a breach of contract so they can say "remove the dog or leave", "remove the dog or lose the bond" or they can evict with very little notice.

      BUT the tenant can also request that the owner of the house make the decision as well to convince for the dog to stay.

      But really if the lease said "No Animals" then the tenant should respect that because they've said it for a reason.

        Bonds are in place only to make good the repair of damage should damage occur and not be rectified by the tenant as required under the conditions of the lease.

        A bond is there for no other purpose. By Law, a bond is required to be lodged with the bonds board (a government department, ministry for fair trading) and can only be released on signed consent from BOTH parties - the Landlord and Tennant. The Landlord cant just take your bond without agreement from you.

        So the answer is no. However, they may refuse to consent to the release of your bond because they claim damages. It doesnt mean they get it if they do but it means that you dont get either. If this happens then you will have to take the landlord to arbitration whereby an arbitrator will rule on who the bond is to be released to, and how much of it goes to each party.

        So bond aside, claiming that you have breached your contract is a different matter and they may (depending on the lease provisions) claim damages from you. This is subject to the conditions of your lease so, have a read.

          ITS ALL GOOD!!!
          just spoke to my landlord (4 days in house) due to someone snooping around yesterday arvo around weights and bike he said "yeah move in the dog (staffy x pitbull) i have no worries there"
