  • Notice of legal action from Champions against Racers PL

Interesting stuff about an interim court order against Racers P/L, in a broadcast email from Champions Ridedays:

"Champion’s Ride Days, well known across the industry for being the only National provider of ride days, offering motorcyclists the opportunity to enjoy their bikes with like-minded enthusiasts, were dealt a savage blow earlier in 2018. “This year our trust and business were impacted massively” said Champion’s Ride Days director Scott Osborne. “Unfortunately, our ex-employee Joshua McFarlane distributed without our permission information including business manuals, passwords, financial information, staff and customer information and provided this material to his new employer RACERS Pty Ltd. The unapproved distribution of our confidential information, is now with the Police also.”

RACERS Pty Ltd under General Manager Terry O’Neill and owner John Tetley was predominantly an insurance company but as of May 2018, employed Joshua McFarlane, registered the business name ‘Track Action Moto Ride Days’, and began running motorcycle track days at Queensland Raceway and Lakeside Raceway in Queensland, where Champion’s Ride Days had previously held a 15-year contract. More recently, Track Action Moto Ride Days have said they will be running ride days at other circuits not owned by John Tetley, where Champion’s Ride Days have previously been running ride day events."
The crux of the biscuit is the apostrophe.

I wonder if Champions insurance coverage was through Racers P/L?

I think most of their stuff is through MA, unsure about Queensland/Lakeside whilst they were running them.

                  Yeah...

At the following tracks, Broadford Raceway, Winton Raceway, Mallala Raceway and Barbagallo Raceway, Champion's Ride Days runs the event under a Motorcycling Australia (MA) permit.

allowed to reach the public - without the company legal folk saying "Don't be dumb, you're opening yourself up to a costly defamation counter-claim"?

So dumb. Even if they can prove information was taken/shared they have soooo much more work to do for anything substantial to come of it.

This could honestly hurt a company the size of Champions significantly.

To get the interim order they'd have their ducks in a row. What's interesting is how new "Track Action" is. May 2018.

The impression I'd formed was that it was an experienced long term east coast provider.

It would appear the only thing that's new is the business name "Racers".

                          Registered May this year.

Historically they've been in the game since 2001 whatever form that was.

Yeah, the Champions argument is that until this year, "Racers" were predominantly event insurers not operators. May 2018 Mcfarlane commenced employment, they registered the 'Racers Track Action' business name and began running track days at 2 QLD tracks where Champions previously held a 15 year contract.

They are claiming their 20 years of IP development was taken by McFarlane and used by TA.

Armed with a Barrister there is more to come. To quote them "It's definitely not over".

EDIT: I guess anyone who's on champions mailing list will get the email.
